Terms and Conditions

Scope
These terms and conditions apply to all purchases made at Sublimify-Store (link to Impressum) by private customers.

Private customers in this sense are persons with residence and delivery address in the Federal Republic of Germany and other countries worldwide, provided that the goods ordered by them can be attributed neither to their commercial nor their independent professional activity.

Contract conclusion
The presentation of our goods and the granting of the possibility to place an order represents a concrete offer on our part to conclude a purchase contract, however, this is only the case as soon as the demo store, which is currently under construction, is functional.

By placing your order, you accept the offer and the purchase contract is concluded.

You will receive an order confirmation by e-mail to the e-mail address you specified.

Prices and shipping costs
Products are freed from “Umsatzsteuer” due to the small business regulation (law in Germany). The amount shown at the time of the binding order applies. Digital products are exempt from shipping costs.

Payment is made upon delivery by means of

Default of payment
If you are in default of payment, Sublimify-Store is entitled to charge interest on arrears at a rate of 5 percentage points above the base interest rate p.a. announced by the Deutsche Bundesbank for the time of the order. If Sublimify-Store can prove a higher damage caused by default, Sublimify-Store is entitled to claim it.

Right of retention
The customer shall only be entitled to exercise a right of retention insofar as its counterclaim is based on the same contractual relationship.

Delivery
(1) Delivery shall be made to the customer’s worldwide via the customer’s customer account. Worldwide means within

– Poland

– Teschchech Republic

– Switzerland

– France

– Luxembourg

– Belgium

– Netherlands

– Europe

– all other countries

(2) If force majeure (natural disasters, war, civil war, terrorist attack) makes the delivery or any other service permanently impossible, a performance obligation of Sublimify-Store is excluded. Already paid amounts will be refunded by Sublimify-Store immediately.

(3) Sublimify-Store can also refuse the service, as far as this requires an effort that is grossly disproportionate to the customer’s interest in the fulfillment of the purchase contract, taking into account the content of the purchase contract and the dictates of good faith. Already paid amounts will be refunded by Sublimify-Store immediately.

Retention of title
Until full settlement of all claims against the customer arising from the purchase contract, the delivered goods remain the property of Sublimify-Store. As long as this retention of title exists, the customer may neither resell nor dispose of the goods; in particular, the customer may not contractually grant third parties any use of the goods.

Applicable law
The contract concluded between you and Sublimify-Store is governed exclusively by the laws of the Federal Republic of Germany with the express exclusion of the UN Convention on Contracts for the International Sale of Goods. The mandatory provisions of the state in which you have your habitual residence remain unaffected.

Jurisdiction
If, contrary to the information you provided when placing your order, you do not have a place of residence in the Federal Republic of Germany, or if you move your place of residence abroad after concluding the contract, or if your place of residence is not known at the time the action is filed, the place of jurisdiction for all disputes arising from and in connection with the contractual relationship shall be resided in Germany.

Youth protection
If goods are purchased that are subject to the protection of minors, an age verification is carried out by appropriate measures to verify the identity and age of the buyer. A handover of the goods will only take place if the customer could prove the age of majority.

Dispute Resolution
General information requirements for alternative dispute resolution in accordance with Article 14 (1) ODR Regulation and Section 36 VSBG (Consumer Dispute Resolution Act):

The European Commission provides a platform for online dispute resolution (OS), which you can find at this address: http://ec.europa.eu/consumers/odr/ . We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.

Final provisions
(1) Should individual provisions of this contract be or become invalid or void in whole or in part, this shall not affect the validity of the remainder of the contract insofar as a contracting party is not unreasonably disadvantaged thereby.

(2) Amendments or supplements to this contract must be made in writing.
